One Resident Reacts to Recent Council Actions

In watching the recent City Council meeting a couple of disturbing ordinances were approved. First, it is unlawful to discharge a gun in your house unless it is self-defense. What is this? We already have an ordinance that says we cannot discharge a gun within the city limits. Law abiding gun owners are not going to be discharging their guns in their homes unless it is self defense. Why should law abiding citizens be grouped in with a few criminals. No I say. It is an outright attack on the second amendment. Why have an added ordinance about discharging a gun in your house? Why??? Are they trying to pick away at our second amendment rights? Our own City? How ridiculous? Is this to protect them if they feel they need to enter your home and you refuse? What is their definition of self-defense?
Second, the other ordinance that they approved is that they can shut down your private well if there is a natural disaster. They claim they want to do this is so our wells don't contaminate their city well. What is their definition of a natural disaster? Is this a way to pressure people into thinking that their well could be shut down and that they would not have water at a time of a natural disaster and might go ahead now and agree to be hooked up to city water? Is this a scare tactic to get us to accept city water when our wells are fine? What if the city well is contaminated during a natural disaster and not the private wells. How can they claim that we could have contaminated their well. Do they test our water or just shut us down? This is unbelievable.
These two ordinances were passed at the same time. Do they go together? In other words, if they force their way into your home claiming they need to shut down your well because of a natural disaster and you disagree, then you cannot protect your home from this. Would they even test your well or just say we don't have time or even if it is not contaminated now, it could become contaminated, and, therefore, contaminate the city water? They would not consider this self-defense.
As far as we are concerned this is way out of line. We do not need these ordinances. First of all it is none of their business to tell us what to do in our own house when it comes to the second amendment and second they do not need to have an ordinance on the books ready to go regarding shutting down our wells at their whim and their definition of natural disaster.
Do the Centerville residents group still meet? This needs to be addressed immediately and try and overturn these ordinances. I think we could be looking at a real problem in the future if we do not hold their feet to fire on this.
In other Council action...
Amended Chapter 50 of the city Code to require connection to public water and sewer systems if private systems “fall into disrepair,” defined as when the cost of repair exceeds $500.

It looks like one way or another they are going to force everyone to hook up to City water and sewer.

Both ordinances are very broad and very vague. A repair of $500 is not uncommon and hardly qualifies a private system to fall into state of "disrepair".
Why should they know what a private resident pays for any repair? What are they up to?

Looks like the City is having trouble finding something to do. I wonder how much money it cost us to draft these new ordinances.

I saya they cannot shut down a well in a natural disaster. First the water must be tested and if it tests suitable to drink, they have no reason to shut it down.

What do we have here in Centerville? A dictator council?

I think it's time to group together and hire a lawyer. this is getting so ridiculous. Before you know it, you will have to get permission from the council to pee.

Citizen Rights be damned!! It is perfectly legal for our CITY ADMINISTRATOR to CONVINCE our COUNCIL to change these ordinances!! FEEL FREE TO LOOK INTO HOW MANY ORDINANCES HAVE BEEN "ARBITRARILY" CHANGED SINCE OUR NEW ADMINISTRATOR CAME TO TOWN! OH AND DON'T FORGET, OUR CITY ATTORNEY MUST HAVE OUR BEST INTERESTS AT HEART TOO (PLEASE)! REMEMBER, NEITHER LIVE HERE! HOWEVER, THE MOST DISTURBING PIECE OF ALL OF THIS IS THE FACT THAT THOSE VOTING TO AGREE TO THESE TYPE OF CHANGES DO LIVE HERE!! I GUESS THIS IS THE TYPE OF RETALIATION THE CITIZENS ARE GOING TO RECEIVE AFTER PROTESTING THE SO-CALLED "ROAD IMPROVEMENT PROJECT"!!

NEXT THING WE KNOW, CITY HALL/COUNCIL WILL AGREE NOT TO TELEVISE COUNCIL MEETINGS SO THE CITIZENS WILL BE FORCED TO COME INTO CITY HALL TO WATCH THE MEETINGS SO THE CITY CAN COME AFTER ANYONE THAT ATTENDS AND REPORTS THEIR SHENANIGANS!!!! UNBELIEVABLE!!

WHAT ARE THEY TRYING TO HIDE?? WELL THE DEBT MUST BE HIGHER THAN ANYONE EVEN KNOWS, IF THIS IS WHAT THEY HAVE TO RESORT TO??

This is ridiculous, why do we need an ordinance on something there is already a State Law on? This is something that would have been done in the 1800's when women's bathing suits had to be below a woman's knee!!

One question: Why, during the election process, is it advertised how much eductation candidates have, when its clear no amount of education can justify this STUPIDITY? Next election, I only want to know if a potential candidate has been able to reproduce - because any idiot can do that!! And, any idiot could write an ordinance like this!

PLEASE DALLAS WHAT DO YOU TAKE US FOR? Blatant & obvious this is just another ploy to get the entire population hooked up to city water. Heck, most times it costs $500 just to have someone walk through the door!

Really now Dallas, what do you take us for? We know what we take you for!! We say, why don't you sell your place in Cannon Falls and move to Centerville - heck, you're helping to make the 'rules', you should live by them!!

A fee is compensation for acts,services, or labor. What acts services or labor are being performed? I believe both of these ordidnances to be written in bad faith and in the very least negligant! I suggest everyone google legal dictionary for interesting browsing! I welcome comments from the new world order!

My favorite ordinance change is the one our illustrious (I use the term loosely) City Administrator changed shortly after "arriving" in Centerville: The one that says the City streets will not be plowed unless there is at least 3 inches of snowfall! Oh and by the way, that 3 inches is determined by the amount of snow that falls in Minneapolis, not Centerville!! Well I for one say, Why should I be expected to keep my sidewalk shoveled with less than an inch of snow, when the City is not expected to plow unless there's 3 inches of snow?!!

P.S. Those only way to get attention to this matter is for everyone who is fed up with sliding through the intersections in Centerville, to CALL Mayor CAPRA at home - try dinner time - I'm sure she would love to hear from you then!!

Is this ordinance on the second amendment even constitutional? Does the Mayor and the City Council even understand our constitutional rights? Maybe it's time to start setting up public citizens' meetings and bring in someone that could educate us on our constitutional rights? Of course, anyone from the City is welcome since most of them are citizens also.

If the 14th comment regarding the city attorney as a paid advisor is an answer to a public meeting with a constitutional specialist as a speaker, lawyers don't learn the constitution in law school they are taught case law. Even though the constitution is supreme law, law schools have them study case law which is an opinion of a judge and that should be questioned. (Did you know, as of right now, judges can accept a $150 tip per day from an attorney or attorneys and not have to report it to the IRS? In other words, he could be receiving several $150/day tips from attorneys and not report this income.) I bet if you brought in a constitutional expert and questioned our city attorney (whom wanted to remove this blog site because he deemed it illegal. Blog site still in existence because of 1st Amendment. He doesn't even know the 1st Amendment or he does but he hopes we don't), city staff, elected officials and even our very own police, you would be surprised how little all these people know about the Constitution even though they have taken the oath to uphold the Constitution. All of our government officials are supposed to serve and protect US! People in this town really have to start flooding the City Hall at meetings and bring in a constitutional expert to educate you on your rights. If there wasn't that much to our constitution, why are there experts in this field? We need to know our constitutional rights so you know when you are being bullied by a government official, you can call their bluff. You would be amazed how many more rights you have than what the government lets you know about. It's time for the citizens to stand together. If it's an issue that affects one or many and you feel it's wrong, stand up for that one or many and say something. We have to. If one person's rights are violated, then everybody's rights are violated. If you don't act now to protect what you still have, you won't even have this blog to type out your frustrations. People that become lazy and complacent deserve the government they get. Patriotism is a never-ending job but well worth it when your reward is liberty and freedom. Ask any soldier that swears on the Constitution to protect this country from any foreign or domestic enemies that in the end if it means keeping our liberty and freedom they would do it all over again. Don't let a few hard working people in this town fight for you. Everyone should be out there putting time into this so the City Hall knows you are serious. If you don't, expect more fees, fines and interference about your private property and that's a sure bet.

We understand that many residents feel passionately about current events here in Centerville.
This blog was created for the purpose of allowing every citizen to feel they have a voice and have that voice heard.
We may not agree or disagree with every comment but do believe that every American has the First Amendment Right to Freedom of Speech.
It is true that the City Attorney wanted this blog investigated for unlawful allegations. We have it on a taped Council session.

Unfortunately, the masses are not swayed until cold, hard reality hits their doorstep.
If everyone in Centerville had their home appraised and discovered how much less equity they have, that would do the trick!
Doesn't anyone care what is going on with property values in Hugo? Everyone should because the same thing is happening here and the city is about to make it worse.

Oh, yes, this does go way back and they were called "the good old boys". That's why this city is layed out the way it is. More houses carrying the tax burden than businesses. Their personal interests came first. However, that is no reason to continue to put up with it. It's time to bring down the tyranny.
