Selective Ordinance Enforcement Part Five

Is the City using the selective ordinance enforcement to impact the election?
City ordinance is quite clear, there shall be no more than one political
sign per candidate per residential property. Why have some residents received letters from the City asking to remove signs in opposition of Mary Capra and Jeff Paar while their signs are left standing? What makes this issue particularly disturbing is the fact that Tom Lee is currently in violation and as a sitting council member, he should know better. Does the current council think they are above the ordinance laws?

The City has been removing signs they consider to be in violation of the ordinance and is dropping them behind the Public Works building, near the dumpster. If you are missing any, this might be a good place to look first.

UPDATE! Council Member Tom Lee is in compliance with the sign ordinance as of this evening.

All candidates are given information on the ordinance for signs and should be monitoring it themselves. It is disturbing that the members of council are disregarding the issue while the City is sending out letters.

In fairness, other candidate's signs are also in violation. Take a drive down Mill Road to see a few examples.

The candidates (both incumbants and non-incumbants) need to be held responsible for this action regardless of who's yard they are in.

This is one reason why you will not see any "Ben Fehrenbacher" signs anywhere in Centerville.

we are not aware of any council members living on mill Rd. i am sure they will be getting their letter soon. this city council is so damned petty!

FYI..............

I believe that Paar, Capra and
Fehrenbacher are campaining together so if you think you like Fehrenbacher I would think twice if you want change in City Hall.

I am not referring to council members that live on mill road... I am referring to signs for an individual placed on Mill road that does not meet the sign ordinance. They are for a person that is not currently on the council. My point is that the incumbants are not the only one in violation.

In regards to me "campaigning" with Paar and Capra... I am not. Do I know them...yes. Do I talk to them....of course, as they are my elected officials. And I respectfully disagree with some of thier votes, but I also agree with many others (Jeff Paar voted against the purchase of the public works building and I agreed with him on this vote).

Also, if you respond to this please include your name..... I wish I knew who I was talking to...that's all.

The glory of blogging!! The City has a more difficult time retaliating against those who don't share the same opinion.

Are you referring to the Halloween "signs" Mr. Fehrenbacher?? I hope not, because those are not "signs", they are decorations.

Ben Fehrenbacher said...

Nope.. I think the Halloween signs are funny. HA! However, I am not looking forward to explaining to my kids what some of them mean when they start to read!

I am referring to some political signs.

Ha Ha! Why would the Mayor Capra allow Tom Lee to put two of her campaign signs in his yard? For as long as they have both been at city hall, either they are both ignorant of the campaign rules or they just didn't think anyone would call them out on it. Either way it's a funny story especially now that Lee took one down! Ha Ha Ha!

Ben,

If you notice those signs are both on corner lots and since we pay assessements on both streets we assumed two signs was ok (one for each street)especially since two sitting council members had two signs in their yard...............

ps.....we are testing the selective enforcement also....and it worked

So 2 wrongs make a right?

that same house on Centerville road with the signs on the backside of their fence is in violation EVERY election year. It was pointed out to Mayor Capra at the last election and guess what, nothing was done. Suprise, suprise. Seriously, don't people have anything better to do than sit around and figure out who is offending them that day so they can call their pals down at the city/cop shop and complain. Hey here's an idea, why don't you stop ringing up the attorney's fee's for your whiny BS and worry about something worth worrying about like how to dig us out of this giant hole we're in. And just an FYI, 800 lights on a 2 block stretch isn't the way to do it. Stop the wasteful spending!!

There will be a follow up to this story. Apparently one of the candidates filed a complaint with the PD regarding their supporters being sent letters from the City demanding removal of duplicate signs. The Centerville ordinance was highlighted.
Our representatives told the cop that after the ordinance compliance letters were issued, they realized that the State law regarding political signs trumps theirs. Of course, there were no letters of apology sent admitting the mistake.
The follow up will include the police report.

Perfect example of the shananigans going on within this monkey run city. Let's spend the money to write the ordinances and not do any research to make sure your within the STATE guidelines, then send out notices letting people know just how much trouble they're going to be in because they are in violation of the city's bogus ordinances only to find out that oops sorry, we made a mistake enforcing our own rules. What a joke! Hey kids, the circus is in town! Can't wait to hear the outcome of this...
